Authorization and Approval Authorities - Article 10, Order #10
The Ministry of Commerce (MOFCOM) or the local provincial commercial bureau have the examination and approval authority. The State Administration of Industry and Commerce and the local provincial bureaus for industry and commerce will have registration administration approval. The State Administration of Foreign Exchange and local provincial bureaus will have control of the foreign exchange.
The local provincial commercial bureau approval authorities will send to the Ministry of Commerce, FIE application documents, when an acquisition has occurred, which according to the law, rules or regulations, are of certain designation or certain business that garner examination or approval. The Ministry of Commerce will approve or disapprove the application based upon the appropriate laws, rules or regulations.
